Benjamin L. Singer
Benjamin Singer is a talented and versatile IP litigator. He spent the better part of a decade working on his craft at two leading IP firms. While at Quinn Emanuel, Ben represented the world's largest companies in their most important patent cases. Inspired by the stories of the early days at Quinn, Ben opened his own Silicon Valley trial boutique in 2009. The firm succeeded on the strength of referrals from former colleagues and adversaries. Having seen the trial lawyers at Quinn transcend traditional practice areas, Ben took on a broad array of IP matters. This past year, in addition to patent disputes, he successfully served as lead counsel in cases involving copyright infringement, trade secret misappropriation, IP license disputes, and criminal IP defense. Now part of an incredible team with remarkable depth, Ben looks forward to taking on even more varied and complex matters in the year ahead.

- Apple, Inc. v. Samsung Electronics Co., Ltd. et al., Case no. 11-cv-01846 (LHK) - Representing defendants Samsung Electronics Co., Ltd., Samsung Elctronics America, Inc. and Samsung Telecommunications America, LLC in a multi-patent litigation brought on by Apple, Inc. This matter is currently pending.
- Certain Electronic Digital Media Devices and Components Thereof (Case No. 337-TA-796) - Representing Samsung Electronics Co., Ltd., Samsung Electronics America, Inc., and Samsung Telecommunications America, LLC as Respondents at the ITC against Apple Inc. This matter is currently pending.
- Certain Electronic Devices, Including Wireless Communication Devices, Portable Music and Data Processing Devices, and Tablet Computers (Case No. 337-TA-794) – Representing Samsung Electronics Co., Ltd. and Samsung Telecommunications America, LLC as Complainants at the ITC against Apple Inc. This matter is currently pending.
- United States v. Doe Defendant - Lead trial counsel for a defendant indicted for IP and financial crimes. This Northern District of California matter is set for trial in early 2012.
- Consilium Wealth Management et al. v. Clarity Wealth et al. (Contra Costa County Superior Court) - Lead trial counsel for a wealth management firm asserting a trade secret, breach of contract, and breach of fiduciary duty claim. This matter is set for trial in late 2012.
- Ryu v. Avon Products, Inc. (N.D. Cal.) – Lead trial counsel for plaintiff and patent owner Bu Kwang Ryu against Avon for patent infringement relating to a cosmetic brush case. The case settled in late 2011 on favorable terms.
- In the Matter of Certain Mobile Telephone Handsets, Wireless Communication Devices, and Components Thereof (ITC) – We were part of a team defending the largest mobile handset manufacturer in the world in an ITC patent trial against one of its primary competitors. After trial, the Commission found that none of the asserted patents were infringed and two were invalid.
- Intellectual Capital Holdings Limited v. Sony Electronics et al (E.D. Tex.) – Represented Sony Electronics and Sony Computer Entertainment America ("SCEA") in a patent infringement suit relating to heat sinks used to cool microprocessors. We convinced the plaintiff to drop the claim against SCEA after proving that the claims could not cover SCEA’s product and still be valid. We then obtained a favorable claim construction ruling that made it impossible for the plaintiff to prove infringement by Sony Electronics. As a result, the plaintiff stipulated to a final judgment of no liability. The Federal Circuit recently affirmed the claim construction.
- International Business Machines Corporation v. Platform Solutions, Inc. (S.D.N.Y.) – Represented IBM in a patent infringement and trade secret misappropriation suit against Platform Solutions regarding its development and sale of IBM architecture emulation software. The case settled on terms very favorable to IBM.
- MediaTek, Inc. v. Matsushita Electric Industrial Co., LTD. et al (N.D. Cal.); Matsushita Electric Industrial Co., Ltd. v. MediaTek, Inc. et al. (E.D. Tex.) – Represented MediaTek in a series of multi-patent lawsuits against Matsushita involving semiconductors and DVD chips. The case settled on very favorable terms after we won rulings on claim construction and summary judgment.
- Sony Corporation v. Vizio, Inc. (C.D. Ca.) – Represented Sony in asserting 14 patents against Vizio relating to its color television and computer monitors. The case settled on terms very favorable to Sony.
- Sony Corporation v. Westinghouse Digital Electronics, LLC (C.D. Ca.) – Represented Sony in asserting 10 patents against Westinghouse relating to its color television and computer monitors. We successfully negotiated a settlement where Westinghouse not only admitted that it infringed all 10 patents, but it agreed to take a license under each patent, which was a complete victory for Sony.
